Both moral and legal theory feature prominent talk about rights. Yet there is very little agreement about what rights are, about why we use rights in our moral or legal theories, or about what to do when there is a conflict between rights. This article surveys many of the popular theory for analysing rights and explaining their scope.

Alan Gewirth extends his fundamental principle of equal and universal human rights, the Principle of Generic Consistency, into the arena of social and political philosophy, exploring its implications for both social and economic rights. He argues that the ethical requirements logically imposed on individual action hold equally for the supportive state as a community of rights, whose chief function is to maintain and promote the universal human rights to freedom and well-being. Such social afflictions as unemployment, homelessness, and poverty are (...) basic violations of these rights, which the supportive state is required to overcome. This essay critically evaluates the claim that competition in medicine destroys the moral integrity of the traditional patient-physician relationship. The author argues that the traditional patient-centered ethic is indefensible on moral grounds, and that it should be jettisoned in favor of a fiduciary ethic. A fiduciary ethic is found to provide the best defensible account of the patient-physician relationship because it takes seriously the roles economic efficiency, competition, and respect for individual self-determination play in fashioning moral health care delivery. Peter Abelard (1079–1142 ce) was the most wide‐ranging philosopher of the twelfth century. He quickly established himself as a leading teacher of logic in and near Paris shortly after 1100. After his affair with Heloise, and his subsequent castration, Abelard became a monk, but he returned to teaching in the Paris schools until 1140, when his work was condemned by a Church Council at Sens. His logical writings were based around discussion of the “Old Logic”: Porphyry's Isagoge, aristotle'S Categories and (...) On Interpretation and boethius'S textbook on topical inference. They comprise a freestanding Dialectica (“Logic”; probably c.1116), a set of commentaries (known as the Logica [Ingredientibus], c. 1119) and a later (c. 1125) commentary on the Isagoge (Logica Nostrorum Petititoni Sociorum or Glossulae). In a work Abelard called his Theologia, issued in three main versions (between 1120 and c.1134), he attempted a logical analysis of trinitarian relations and explored the philosophical problems surrounding God's claims to omnipotence and omniscience. The Collationes (“Debates,” also known as “Dialogue between a Christian, a Philosopher and a Jew”; probably c.1130) present a rational investigation into the nature of the highest good, in which the Christian and the Philosopher (who seems to be modeled on a philosopher of pagan antiquity) are remarkably in agreement. The unfinished Scito teipsum (“Know thyself,” also known as the “Ethics”; c.1138) analyses moral action. (shrink)

It is natural to read this debate as a debate between a realist and an anti-realist. It was difficult to avoid the amiability of [Shaw's] impersonal embrace. Everything he seemed to say was what it was—and another thing. Women were the same as men: but different. But of the two, he calculated, women were fractionally less idiotic than men. "The only decent government is government by a body of men and women," he said in 1906; "but if only one sex must govern, then I should say, let it be women—put the men out! Such an enormous (...) amount of work is done of the nature of national housekeeping, that obviously women should have a hand in it." Shaw favored women over men in much of the same spirit as he advertised Roman Catholics being a trifle superior to Protestants. Both preferences were the product of a Protestant gentleman who delighted in perverse exhibitions of fairness. Certain consequences followed from the fact that only women became pregnant. Had Shaw had the making of the world in the first place, and not merely the remaking of it, things might have been ordered more sensibly. However, the rules had been laid down and the worst thing you could do was to complain of them. Every grievance was an asset in the womb of time. The advantage to women came in the form of greater natural wisdom about sex. They could hardly help themselves. Shaw maintained that the instinct of women acted as a sophisticated compass in steering our course for the future. His disenchantment with the human experiment expanded during and after the First World War. In Heartbreak House—"my Lear" he called it—he shows us what he supposed to be a "Bloomsburgian" culture where the feminine instinct has been trivialized in such a way that it no longer gives us our true bearings, and we drift towards the rocks. We had defaulted in our contract with the Life Force and would probably be superseded by another partner. Regardless of its ontological status and seemingly subsidiary role, the beyond—real, oneiric, imaginary, or otherworldly—constitutes, I intend to argue, an indispensable and complementary component of any dystopian reality. Paradoxically, it may be claimed that what lies outside a given dystopia—beyond its impassable boundaries—determines, ultimately, whether we deal with the Orwellian or the Hollywood type of "bad world."1 Contrary to the latter, the former systematically compromises and eliminates one kind of the beyond after another, leaving its inhabitants with neither space nor (...) time nor discourse that could allow them to imagine that they are behind the confines of dystopia. Reflections by leading Latin American and African American philosophers on their identity within the field of philosophy.

The author traces the thought of George Santayana, Brad S. Gregory, Pierre Manent, and Rémi Brague, who addressed the transformation of the West into its modern present. They all show that by being cut off from its cultural and political inheritance in modern times, Western Civilization presently finds itself in a burning need of recovering its identity. To save its identity, the West is to challenge the errors of modernity. We used to have the example of Winston Churchill (...) and Charles de Gaulle in the darkest hours of World War II, and the remarkable example of John Paul II who through his leadership of the Solidarity movement inspired hope not only in his own people but also for others in the Soviet bloc at the time. “The cultural task awaiting Europe,” to use a phrase of Rémi Brague, challenging though it may be, may in time find its voice in another Churchill or John Paul II. If a person's head moves, she may or may not have moved her head, and, if she did move it, she may have actively performed the movement of her head or merely, by doing something else, caused a passive movement. And, if she performed the movement, she might have done so intentionally or not. This short array of contrasts (and others like them) has motivated questions about the nature, variety, and identity of action. Beyond the matter of her moving, when (...) the person moves her head, she may be indicating agreement or shaking an insect off her ear. Should we think of the consequences, conventional or causal, of physical behavior as constituents of an action distinct from but ‘generated by’ the movement? Or should we think that there is a single action describable in a host of ways? Also, actions, in even the most minimal sense, seem to be essentially ‘active’. But, how can we explain what this property amounts to and defend our wavering intuitions about which events fall in the category of the ‘active’ and which do not? (shrink)

Written in the intense political and intellectual tumult of the early years of the Weimar Republic, _Political Theology_ develops the distinctive theory of sovereignty that made Carl Schmitt one of the most significant and controversial political theorists of the twentieth century. Focusing on the relationships among political leadership, the norms of the legal order, and the state of political emergency, Schmitt argues in _Political Theology_ that legal order ultimately rests upon the decisions of the sovereign. According to Schmitt, only the (...) sovereign can meet the needs of an "exceptional" time and transcend legal order so that order can then be reestablished. Convinced that the state is governed by the ever-present possibility of conflict, Schmitt theorizes that the state exists only to maintain its integrity in order to ensure order and stability. Suggesting that all concepts of modern political thought are secularized theological concepts, Schmitt concludes _Political Theology_ with a critique of liberalism and its attempt to depoliticize political thought by avoiding fundamental political decisions. The Philosophy of Rhetoric is widely regarded as the most important work of a theory of rhetoric produced in the 18th century. Campbell's work engages such themes in an attempt to formulate a universal theory of human communication. Campbell attempts to develop his theory by discovering deep principles in human nature that account for all instances and kinds of human communication. He seeks to derive all communication principles and processes empirically. In addition, all statements in discourse that have to do (...) with matters of fact and human affairs are likewise to be empirically derived. Thus, his theory of rhetoric is vastly wider than, and different from, such classical theories as those proposed by Aristotle, Cicero, and Quintilian, whose theories focused on discourse related to civic affairs. By attempting to elaborate a general theory of rhetoric through empirical procedures, Campbell's project reveals the limitations of his method. He cannot ground all statements empirically and it is at this point that his theological position comes into play. Inspection of his religious views shows that God's design of human nature, and God's revelations to humankind, make moral and spiritual truths known and quite secure to human beings, although not empirically.
